The latest statistics show that divorce rates are rising, and more couples are deciding that they would rather not fight and spend their limited financial resources. Our services offer a good solution to situations where you and your spouse agree on the terms of your divorce.
Requirements:
1) You must be a resident of Texas for six (6) months, and of your county for ninety (90) days before filing the Petition for Divorce.
2) Your spouse must be in the State of Texas, and you must know where your spouse is.
3) You or your spouse cannot be pregnant, regardless of who the father is, and you or your spouse cannot be in the process of adopting a child.
4) Neither you nor your spouse can be an active, current member of the military.
5) Your spouse will sign a Waiver of Service, in front of a notary.
6) Neither you nor your spouse has filed a bankruptcy action that would stay the divorce proceeding. If you or your spouse has filed for bankruptcy, please contact our office.
7) There has not been any finding of domestic violence or any charges or protective orders filed within the past two years.
8) You and your spouse must agree on all property and debt division, and you must agree that property and debt will be divided so that each party keeps what is in his or her own name. You may transfer and divide the property however you like prior to the divorce, so that you meet this requirement. 9) You and your spouse must agree on all child issues, and you must agree as follows:
a. that you will be joint managing conservators;
b. that one of you will be the person who can designate the primary residence of the child(ren);
c. that the other person will pay child support pursuant to Texas Family Code child support guidelines, or in an amount that is agreed;
d. you must be able to provide proof of income (such as a recent paystub), otherwise, the default amount will be based on minimum wage rates;
e. that the other person will either pay/reimburse the monthly premiums for health insurance for the child(ren) or will maintain the health insurance coverage himself/herself;
f. that the other person will have visitation by mutual agreement, and in the event of disagreement, then pursuant to Texas Family Code Standard Possession schedule.

Option 1: Do-it-yourself Uncontested Divorce
We will draft the documents only. We will provide you with an instruction sheet on how to serve your spouse and prove-up your divorce. We do not guarantee the outcome of your case.
Without children – Cost: $350.00 (does not include filing fees)
With children – Cost: $500.00 (does not include filing fees)
Option 2: Attorney Assisted Uncontested Divorce
We will draft and file your documents for you. Our attorney will represent you in court on the day of the prove up hearing. You will have access to up to one hour of support and advice by telephone or email, and you will receive copies of your final divorce documents at no additional cost.
Without children – Cost: $750.00 (does not include filing fees)
With children – Cost: $950.00 (does not include filing fees)
